These Terms of Service ("Terms") constitute a legally binding agreement between you and EZ FLOW LABZ SDN. BHD. (Company No. 202201026529 (1472226-H)), governing your access to and use of EZLEASE. Please read these Terms carefully before using our services.

1. Definitions and Interpretation

1.1 Definitions

In these Terms, unless the context otherwise requires:

  • "EZLEASE" or "Platform" refers to the rental property matching and verification service operated at ezlease.my and any related mobile applications or services provided by the Company.
  • "Company", "we", "us", or "our" refers to EZ FLOW LABZ SDN. BHD.
  • "User", "you", or "your" refers to any individual or entity accessing or using the Platform.
  • "Tenant" refers to a User seeking rental accommodation through the Platform.
  • "Owner" or "Landlord" refers to a User offering rental properties through the Platform.
  • "Verification Documents" refers to identity documents, financial documents, property documents, and any other documentation submitted for verification purposes.
  • "Services" refers to all features, functionality, and services provided through the Platform.

1.2 Interpretation

References to statutory provisions include those provisions as amended or re-enacted. Headings are for convenience only and do not affect interpretation.

2. Description of Service

2.1 Platform Purpose

EZLEASE operates as a trusted intermediary platform that connects prospective Tenants with Owners of rental properties in Malaysia. The Platform facilitates:

  • Identity and document verification for Tenants and Owners
  • Property listing and discovery
  • Communication between verified Users
  • Display of verification status without exposing underlying documents

2.2 Intermediary Role

The Company acts solely as an intermediary platform. We do not:

  • Act as a real estate agent, property manager, or landlord
  • Enter into rental agreements on behalf of Users
  • Guarantee the accuracy of property listings or User representations
  • Assume liability for transactions between Users
  • Provide legal, financial, or property advice

3. Eligibility and Account Registration

3.1 Age Requirement

You must be at least 18 years of age to use the Platform, as required by the Age of Majority Act 1971. By creating an account, you represent and warrant that you meet this age requirement.

3.2 Account Creation

To access the Services, you must create an account by providing accurate and complete information including:

  • Full legal name
  • Valid email address
  • Malaysian mobile phone number
  • Secure password

3.3 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access or security breach
  • Ensuring your account information remains accurate and up to date

3.4 Single Account Policy

Each User may maintain only one active account. Multiple accounts created by the same individual may be suspended or terminated without notice.

4. User Obligations and Responsibilities

4.1 General User Obligations

All Users must:

  • Provide truthful, accurate, and complete information
  • Comply with all applicable Malaysian laws and regulations
  • Respect the rights and privacy of other Users
  • Use the Platform only for lawful purposes
  • Not misrepresent their identity, qualifications, or intentions

4.2 Tenant Obligations

Tenants using the Platform agree to:

  • Provide genuine and unaltered Verification Documents including MyKad (Malaysian Identity Card), income proof, and employment details
  • Ensure all financial information provided is accurate and current
  • Update their profile if their financial or employment circumstances change materially
  • Understand that CTOS credit report submission is optional but may enhance their profile credibility
  • Engage in good faith negotiations with Owners
  • Not make false representations about rental history or references

4.3 Owner/Landlord Obligations

Owners using the Platform agree to:

  • Provide genuine and unaltered Verification Documents including MyKad, property title documents, grant documents, and Sale and Purchase Agreement (SPA) pages
  • Verify that they have legal authority to rent the listed property
  • Provide accurate descriptions, photographs, and rental terms for properties
  • Ensure properties meet applicable safety and habitability standards under Malaysian law
  • Not discriminate against prospective Tenants based on race, religion, gender, or other protected characteristics
  • Disclose any material defects or issues with the property

5. Document Submission and Verification

5.1 Verification Process

Users may submit Verification Documents to enhance their credibility on the Platform. By submitting documents, you:

  • Authorize the Company to review and verify the authenticity of submitted documents
  • Represent that all documents are genuine, unaltered, and accurate
  • Understand that verification is performed manually by authorized Company personnel
  • Acknowledge that document verification does not constitute an endorsement or guarantee by the Company

5.2 Document Confidentiality and Visibility

The Company maintains strict confidentiality protocols:

  • Tenant Documents: MyKad, income proof, CTOS reports, and employment details are visible ONLY to authorized EZLEASE verification personnel. Owners and other Users will NEVER see these raw documents.
  • Owner Documents: MyKad, property titles, grant documents, and SPA pages are visible ONLY to authorized EZLEASE verification personnel. Tenants and other Users will NEVER see these raw documents.
  • Verification Status: Other Users will only see whether you are verified or not verified. The underlying documents remain confidential.
  • No User-to-User Sharing: The Platform does not share any User's personal documents with other Users under any circumstances.

5.3 Document Authenticity

Submission of forged, altered, or fraudulent documents constitutes a material breach of these Terms and may result in:

  • Immediate account termination
  • Permanent ban from the Platform
  • Reporting to relevant Malaysian authorities
  • Legal action for fraud or misrepresentation

5.4 Optional Documents

Certain documents, such as CTOS credit reports, are optional. Users may choose whether to provide such documents. The Company will not penalize Users for declining to submit optional documents.

6. Payment Terms and Subscriptions

6.1 Service Fees

The Platform may offer both free and paid subscription tiers. Paid services may include:

  • Monthly or annual subscription plans
  • Lifetime access deals
  • Premium features and enhanced visibility
  • Priority verification processing

6.2 Payment Processing

Payments are processed through third-party payment processors including BillPlz. The Company does not store or process credit card information directly. By making a payment, you agree to the payment processor's terms and conditions.

6.3 No Refund Policy

ALL PURCHASES ARE FINAL AND NON-REFUNDABLE. This includes:

  • Monthly and annual subscriptions
  • Lifetime access deals
  • Any promotional or discounted purchases
  • Partially used subscription periods

By completing a purchase, you acknowledge and agree to this no-refund policy.

6.4 Subscription Renewal

Recurring subscriptions will automatically renew at the end of each billing period unless cancelled before the renewal date. You are responsible for cancelling your subscription if you do not wish to continue.

6.5 Price Changes

The Company reserves the right to modify pricing at any time. Price changes will not affect existing subscriptions until the next renewal period, and you will be notified at least 30 days before any price increase takes effect.

7. Acceptable Use Policy

7.1 Prohibited Conduct

Users must not:

  • Use the Platform for any illegal, fraudulent, or unauthorized purpose
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Upload or transmit viruses, malware, or any code of a destructive nature
  • Attempt to gain unauthorized access to the Platform, other User accounts, or computer systems
  • Interfere with or disrupt the Platform or servers or networks connected to the Platform
  • Harvest or collect information about other Users without their consent
  • Use automated scripts, bots, or scrapers to access the Platform
  • Submit false, misleading, or fraudulent information
  • Harass, abuse, or harm other Users
  • Post discriminatory, defamatory, or offensive content
  • Use the Platform to solicit business for competing services

7.2 Content Standards

All User-generated content, including property listings, messages, and profile information, must:

  • Be accurate and not misleading
  • Comply with all applicable Malaysian laws
  • Not infringe intellectual property rights of third parties
  • Not contain obscene, pornographic, or offensive material
  • Not contain personal information of third parties without their consent

7.3 Enforcement

The Company reserves the right to investigate violations of these Terms and take appropriate action, including content removal, account suspension, or termination, without prior notice.

8. Intellectual Property Rights

8.1 Company Intellectual Property

The Platform, including its design, software, code, text, graphics, logos, and trademarks ("EZLEASE" and related marks), are owned by or licensed to the Company and protected by Malaysian and international intellectual property laws.

8.2 Limited License

The Company grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes in accordance with these Terms. This license does not include any right to:

  • Reproduce, distribute, or publicly display any part of the Platform
  • Modify or create derivative works based on the Platform
  • Reverse engineer, decompile, or disassemble any software
  • Remove or alter any proprietary notices

8.3 User Content Ownership

You retain ownership of all content you submit to the Platform, including Verification Documents, property listings, photographs, and messages. However, by submitting content, you grant the Company a worldwide, non-exclusive, royalty-free license to use, reproduce, store, and display such content solely for the purposes of operating and improving the Platform.

8.4 User Document Ownership

All Verification Documents submitted by Users remain the property of the User. The Company's use of such documents is limited to verification purposes and is subject to our Privacy Policy and the Personal Data Protection Act 2010.

9. Disclaimers and Limitation of Liability

9.1 No Warranties

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY MALAYSIAN LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties regarding the accuracy, reliability, or completeness of content
  • Warranties that the Platform will be uninterrupted, secure, or error-free
  • Warranties regarding the conduct or representations of other Users

9.2 No Endorsement or Guarantee

Verification of documents does not constitute:

  • An endorsement, recommendation, or guarantee of any User
  • A warranty of creditworthiness or financial stability
  • A guarantee of property ownership or legal authority to rent
  • Assurance that a rental transaction will be successful or satisfactory

9.3 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY MALAYSIAN LAW, THE COMPANY SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or goodwill
  • Damages arising from interactions between Users
  • Damages resulting from property transactions arranged through the Platform
  • Damages caused by fraudulent or misleading information provided by Users
  • Damages arising from unauthorized access to your account
  • Damages resulting from service interruptions or technical failures

9.4 Maximum Liability

In any event, the Company's total aggregate liability to you for all claims arising from or related to the Platform shall not exceed the amount you have paid to the Company in the twelve (12) months preceding the claim, or RM100, whichever is greater.

9.5 Indemnification

You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Platform
  • Your breach of these Terms
  • Your violation of any rights of third parties
  • Your submission of false or fraudulent information

10. Account Termination and Data Deletion

10.1 Termination by User

You may terminate your account at any time through the Platform's account settings or by contacting us at hello@ezlease.my. Upon termination:

  • Your access to the Platform will be immediately revoked
  • You may request deletion of all your personal data in accordance with Section 10.3
  • No refunds will be provided for any unused subscription period

10.2 Termination by Company

The Company reserves the right to suspend or terminate your account immediately, without prior notice, if:

  • You breach any provision of these Terms
  • You submit fraudulent or forged documents
  • You engage in conduct harmful to other Users or the Platform
  • We are required to do so by law or court order
  • We discontinue the Platform or any part thereof

10.3 Data Deletion Rights

In accordance with the Personal Data Protection Act 2010, you have the right to request deletion of all your personal data. You may exercise this right:

  • Through the in-app data deletion feature
  • By sending a written request to privacy@ezlease.my

Upon receiving a valid deletion request, we will permanently delete your personal data and Verification Documents within thirty (30) days, except where retention is required by Malaysian law.

10.4 Effect of Termination

Upon termination of your account:

  • All licenses granted to you under these Terms will immediately cease
  • Sections relating to intellectual property, indemnification, limitation of liability, and dispute resolution will survive termination
  • You will remain liable for any obligations incurred before termination

11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia, including but not limited to:

  • Personal Data Protection Act 2010
  • Contracts Act 1950
  • Consumer Protection Act 1999
  • Communications and Multimedia Act 1998

11.2 Jurisdiction

You irrevocably submit to the exclusive jurisdiction of the courts of Malaysia for the resolution of any disputes arising from or relating to these Terms or your use of the Platform. Any legal action or proceeding must be brought in the Malaysian courts.

11.3 No Arbitration

The parties agree that disputes will be resolved through the Malaysian court system. There is no requirement for arbitration or alternative dispute resolution before commencing legal proceedings.

11.4 Dispute Notification

Before initiating formal legal proceedings, you agree to notify the Company in writing of any dispute at hello@ezlease.my and allow thirty (30) days for amicable resolution.

12. Changes to Terms

12.1 Amendment Rights

The Company reserves the right to modify these Terms at any time. When we make material changes (major version updates), we will:

  • Update the version number and effective date at the top of this document
  • Send notice to your registered email address at least fourteen (14) days before the changes take effect
  • Display a prominent notice on the Platform

12.2 Version Control

We maintain version control of these Terms as follows:

  • Major updates (e.g., 2.0.0): Significant policy changes affecting user rights
  • Minor updates (e.g., 1.1.0): New clauses or service additions
  • Patch updates (e.g., 1.0.1): Clarifications or corrections

12.3 Acceptance of Changes

Your continued use of the Platform after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the modified Terms, you must discontinue use of the Platform and may terminate your account.

13. Miscellaneous Provisions

13.1 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed and the remaining provisions shall continue in full force and effect.

13.2 Waiver

No waiver of any provision of these Terms shall constitute a waiver of any other provision, nor shall any waiver constitute a continuing waiver. Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.

13.3 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. The Company may assign these Terms without restriction. Any attempted assignment in violation of this section shall be void.

13.4 Entire Agreement

These Terms, together with our Privacy Policy and PDPA Compliance Statement, constitute the entire agreement between you and the Company regarding the Platform and supersede all prior agreements, understandings, and communications, whether written or oral.

13.5 Language

These Terms are drafted in English. In the event of any translation, the English version shall prevail.

13.6 Force Majeure

The Company shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including acts of God, natural disasters, war, terrorism, strikes, government restrictions, or internet service provider failures.
